Trusts take effect when assets are transferred to beneficiaries, not when a person dies as is the case with wills. A “living trust” can be established while the grantor is still alive. Or a trust could be a “testamentary trust,” established following a grantor’s passing in accordance with instructions in their will.

What Are Trusts?
Trusts are formal agreements that allow for the transfer of property from the grantor or trustor, who owns the asset, to the trustee. They provide the guidelines for the trustee’s oversight of the assets, for payments to one or more selected beneficiaries, and for the assets’ eventual disposition. As a fiduciary, the trustee has a duty to manage the trust’s assets solely for the benefit of the beneficiaries and in line with the conditions of the trust agreement.
